If you use the "Create relative to Active 1" option it should be on the same layer as Active 1.

I've discovered that hiding and showing layers while the play area is scrolling can result in some pretty wacky things... =|

I just noticed when I created a third layer it keeps coloring the whole screen with the frame's background color, only showing the newest layer, no matter where I order it.
