Add Backdrop / Paste Image [HWA]

I've run into a serious flaw this morning that doesn't seem to be helping matters.

When I coded this engine in Standard Runtime, I create a loop which reads from an INI file to create the level. This works fine and the loop looks like this:
    help1.jpg
    help2.png
In Standard Runtime, it loads the Tree active which is a tree. It then pastes the tree into layer two which is the playable scene, destroys object. Works fine.

In DirectX 9 Mode it isn't building the level. When I do a soundcheck for conditions and groups opened and loop check it is audible so the loop is running. I deleted 'Add Backdrop' to which the actives where placed on the level and job was done. So it appears Add as Backdrop or Paste as Image isn't working (no matter what setting: ie(obstacle, no collision). Rendering the level unplayable because it isn't building it for me.

The second I switch back to Standard from DX9 with no code modification it works fine. So I am assuming there is a bug with the HWA routine?! Or is there an alternative random weird setting somewhere in the actives properties that I haven't checked?!

    Answers on a postcard.

I cannot send the MFA John boy, it's a private contract and I don't have the time to rebuild the entire engine to reproduce the problem.

I have built a simple reproduction that works fine, so I am going to have to try go through all the code with a fine toothcomb. As I said it works fine on standard, however, HWA it doesn't. I do know that HWA doesn't draw to one background and treats backdrops individually, however, I have yet to come across a solution for this in regards to this project.

N.B I am using the 'Create By Name' extension and I am wondering if this could be the root of the cause as it is not creating the actives in HWA without pasting as backdrops, just leaving the Actives in. However in standard it works fine with no modification. The Create by Name extension uses a 0-based index when positioning on layers...

    Confirmed, sorry for triple post

It IS the Create by Name extension that is causing the problem in HWA.
